Breaking: NSW Court Strikes Down Protest Laws as Unconstitutional

The New South Wales Supreme Court ruled Thursday that amendments to state protest laws enacted in February are invalid, finding they unconstitutionally burden Australians’ freedom of political communication. Justice Anna Mitchelmore declared the laws, which gave police broad authority to direct protesters away from places of worship even without evidence of obstruction or harassment, exceeded legitimate bounds and violated the implied constitutional freedom established by High Court precedent.

The ruling represents a significant legal defeat for Premier Chris Minns’ government, which introduced the amendments following a series of antisemitic incidents across Sydney. Josh Lees of Palestine Action Group, who brought the constitutional challenge, said outside court that the decision upholds the right to protest in New South Wales. The state government has not yet indicated whether it will appeal the decision or attempt to redraft the legislation with narrower language that might withstand constitutional scrutiny.
